A Report on the issues of Hajj

Staying in Arafa :
1- Scholars are consensus that staying in A`rafa is one of the pillars of Haj based on relevant evidences (daleel).
2- A`rafa comes on the 9th Dhulhijah, while the 8th of Dhulhijah is called Tarwiyah day.
3- One who was totally incapable of staying at A`raf till Fajr of Eid day, must return back to Ka`ba and performs Tawaf and Sa`y which will be counted as Ummrah. Then shaves hair. In case this one was the Fard Haj, he/she must return the next year to perform it.
4- The duration that must be spent in A`rafa begins at the Fajr of the 9th till Fajr of Eid Day (10th Dhulhijja).
5- One must ensure during the stay in A`rafa to remain within its boundaries. As A`rafa is a specified location and its boundaries are determined by Shari`a.
6- In case people mistaken the day of A`rafa for another day and realized this fault while being there, their Haj is still valid.
7- In case people while in A`rafa found out that it was Eid day, they just leave A`rafa and in such case their Haj is still valid.
8- Regarding the validity of Haj, the part of the group who remained within the boundaries of A`rafa performed a valid Haj while those who didn’t invalidated theirs.
9- It is allowed to stay in any spot included within the boundaries of A`rafa except the area called Orana. The Messenger Salla Allah a`lyhee wa sallam said:” Do not stay at O`rana”.
10- As for the departure time from A`rafa, the Sunnah is not to leave before sunset (Maghreb). It is a violation of Sunnah to leave before Maghreb. However, in this case one must return back but a ransom is not required.
11- It is recommended to keep making rememberance of Allah and dua on that day. According to hadeeth reported by Termidhi, it is recommended to use the dua:
12- “ la ilaha ila Allah wahdahu la shareeka lahu lahulmolk walahul hamd wahuwa a`la kul shay-en qadeer” a lot.
13- The meaning is No Deity but Allah Alone with no partner or associate, to Him is the rule and to Him is the praise and He Is Capable of everything.
14- It is the best dua to be made at A`rafa. However, other dua are permissible to be made.
15- It is also allowed to make Talbiyah at A`rafa, better yet to make dua.
16- Fasting the day of A`rafa while performing Haj is not Sunnah. According to a hadeeth reported by Bukhari, the Messenger Salla Allah a`lyhee wa sallam was not fasting.
17- For a valid Haj, it suffices for one to stay in A`rafa only for one hour either day or evening before the Fajr of Eid day.
18- Many people due to the increasing number of Muslims performing Haj prefer to make the stay in A`rafa during the evening time. In this case, although they went against the sunnah, yet their Haj is valid.
19- It is also against the Sunnah to spend A`rafa day sleeping, yet the Haj is valid.
20- But the Haj would be invalid, in case one fainted for the most part of A`rafa day.
21- According to confirmed Sunnah, it is necessary to combine Zohr and Asr prayer. In this case, one Adhan is called for but two Eqamats (the second call indicating the initiation of prayer) are made. This is how the Messenger Salla Allah a`lyhee wa sallam behaved while in A`rafa.
22- Climbing the mountain called as (Jabalerahma) is not Sunnah and thus not preferable to do it. The Prophet Salla Allah a`lyhee wa sallam actually remained on surface not on the mountain while in A`rafa.
23- It is preferable to try and forbid evil than making dua and dhikr while in A`rafa.
24- As for the preferred position during the stay in A`rafa (sitting or standing up), Ibn Qaiyem and Ibn Taymiyah saw that one takes the adequate position for him/herself.
25- The Messenger Salla Allah a`lyhee wa sallam used to raise his hands while making dua at A`rafat. Thus it is recommended to follow his suit in this regard.
26- It is not part of the Sunnah to make congregational dua but rather each makes whatever dua he/she wants.
27- According to Sunnah, one must not fast during the day of A`rafa while at A`rafa even if he/she can. It was proved that the Messenger Salla Allah a`lyhee wa sallam as well as the companions ate while at A`rafa.
28- While departing from A`rafat, one must maintain a calm and modest attitude based on the hadeeth of the Messenger Salla Allah a`lyhee wa sallam instructing people and saying:” Making a sign with his hands to express and saying calmness”.
